Minutes of a Public Hearing held on Monday, August 16, 2004 at 7:00 p.m. in the Council Chambers of City Hall.

Mayor Phillips read the rules of procedure for the evening’s public hearings.

Mayor Phillips introduced the following bylaw:

Zoning Amendment Bylaw No. 1349

Lot A, D.L. 150, K.D.Y.D., Plan 35976, 130 Cliffview Lane from Residential Mobile Home Park Zone (R.5) to Residential Single Family Zone (R.1-A), which rezoning would facilitate a strata-subdivision of the existing modular home park spaces. (Eckhard and Kathleen Fabische)

Mayor Phillips invited comment from the public regarding the above noted bylaws.

Mr. van Rutlidge of #6 — 130 Cliffview Lane expressed his concerns about the re-zoning and whether or not the tenants would one day have to purchase the lots their homes are on. Kathy Fabische, the owner of the property will speak to this issue following all speakers.

Deryck Stevens of #20 — 153 Salmon Arm Drive questioned whether the R1A zoning would permit the construction of 2 storey homes and whether the status of the complex would no longer be adult oriented. The Administrator explained that R1A zone does allow for 2 story homes and that it would be the strata council which would control the type of development.

Ken Bond of #8 — 130 Cliffview Lane stated that it has been a pleasant living environment and that the owners have assured him that there will be no changes. He feels that the Fabische’s are honourable people and he has no reason to doubt their word. It is purely a business decision and with no impact, he sees no reason to oppose.

Kathy Fabische made the following comments:

Morris Ervin of #5 — 130 Cliffview Lane expressed that he did not feel it was right that the property could be strata’s and be occupied by renters at the same time.

Robert Bettles of #21 — 130 Cliffview Lane enquired as to whether the property would be permitted to have more than one zoning and whether or not a strata could apply to only part of the property. He expressed concerns over strata rules as a renter. The Administrator explained that the property in question has one title and therefore there can be only one zone for the entire property.

Dr. Russ Weibe of #1 — 130 Cliffview Lane stated that once each lot is strata’d, it would either be owned or rented from the stata’s owner.

Jack Sheldon of 23 — 153 Salmon Arm Drive expressed his concern that 2 storey homes could be constructed on the lots.

There were no further comments or submissions relating to the above noted bylaws.

Mayor Phillips introduced the following bylaw:

Zoning Amendment Bylaw No. 1350

A Bylaw to amend the text of Zoning Bylaw 966, 1987 by adding a provision to allow properties larger than 1.0 ha to have a temporary residence for the medical care of an immediate relative.

Mayor Phillips invited comment from the public regarding the above noted bylaws.
