Development Variance Permit Application No. 06-0362-END-DVP
Del Purnell of 2021 12th Avenue S. E., Salmon Arm B. C. addressed Council:
- Does not know what the City wants.
- Learned of Councils intent to deny request by reading local paper.
- Is willing to comply with underground wiring issue, but has problem with rejection of panhandle issue.
- Without the panhandle variance, the development will have to be made smaller.
- In order to build Purnell Drive at a cost of $375,000 and make a profit he is asking for 9 lots.
- He feels that the OCP is in the way of his development plans. Engineers have indicated that due to the topography of the property, the property cant be developed beyond what they are proposing. Any further development would have to come from the other side of the property.
- Sees no reason why existing plans cannot go forward.
Jonathan Turpin of 223 Salmon Arm Drive has no objections since the applicant is willing to comply with the underground wiring issue.
Mayor Phillips read into record a written submission from Donald and Ellen Vancise of 227 Salmon Arm Drive.

Councillor Vetter declared a personal bias and excused himself from the meeting.
The Planner introduced the application and reviewed the recommendation from Development Services.
Moved by Councillor Shipmaker, seconded by Councillor Ludwig that Council authorize the issuance of Development Variance Permit No. 06-0275-END-DVP for Lots 1, 2 and 3, Section 26, Township 18, Range 9, West of the 6th Meridian, Kamloops Division Yale District, Plan KAP78763 located at 140, 144 and 148 Cliffview Drive;
AND THAT Section 7.3 and 7.4 of Schedule A and Schedule B of the City of Enderby Subdivision Servicing and Development Bylaw No. 1278, 2000 be varied by waiving the requirement to provided underground servicing (wiring) subject to the following:
1. The existing poles on the properties be permitted to remain in order to continue to provide overhead services to other properties in the Cliffview Drive area; and
2. The houses to be constructed on Lots 1, 2 and 3 of Plan KAP78763 be serviced with underground wiring.

AND THAT Section 402.4(a)(i) of the City of Enderby Zoning Bylaw 966, 1987 be varied by reducing the front yard setback for an accessory residential building (gazebo) from 8 metres to 5.56 metres;
AND THAT Section 402.4(a)(i) of the City of Enderby Zoning Bylaw No. 966, 1987 be varied by reducing the exterior side yard setback for an accessory residential building (gazebo) from 8 metres to 4.47 metres;
AND THAT Section 402.4(a)(iii) of the City of Enderby Zoning Bylaw 966, 1987 be varied by reducing the setback for an accessory residential building (gazebo) from any other building from 3 metres to 2.43 metres.

The Planner introduced the application and reviewed the recommendation from Development Services.
Discussion:
Councillor Vetter queried whether placing a covenant on the property to restrict future development would be a consideration. The Planner stated that although access from Timberland Road might be a better option, there is no guarantee that access would be built in the future. The panhandle issue still affects park access.
Moved by Councillor Case, seconded by Councillor Shipmaker that Council deny the following requested variances in relation to Lot E, Section 27, Township 18, Range 9, West of the 6th Meridian, Kamloops Division Yale District, Plan 5293 Except: [1] Parcel G (DD 152175F and Plan B6998) [2] Plans 7600, 10853, 17166, 28974 and KAP46393; and Parcel G (DD152175F and Plan B6998) of Lot E, Section 27, Township 18, Range 9, West of the 6th Meridian, Kamloops Division Yale District, Plan 5293, Except Plan KAP59464 located at 16 and 24 Purnell Drive;
- Request to vary Section 7.3 and 7.4 of Schedule A and Schedule B of the City of Enderby Subdivision Servicing and Development Bylaw 1278, 2000 by waiving the requirement to provide underground servicing (wiring);
- Request to vary section 1201.1(c)(ii) of the City of Enderby Zoning Bylaw 966, 1987 by reducing the minimum width for a panhandle where a lot can be further subdivided from 20 metres to 6 metres.

The Planner introduced the application and reviewed the recommendation from Development Services. There is a significant lack of details provided by the applicant.
Discussion:
- It would be necessary to study the water and sewer capacity prior to considering such a development. It is possible that our systems are not adequate to support even the existing OCP plan.
- The OCP identifies areas closer to downtown for multi-family development. This application is contrary to the OCP.
- The Citys water and sewer capacity should be determined before considering first reading of the amendment bylaws.
Moved by Councillor Cyr, seconded by Councillor Ludwig that Official Community Plan Amendment Bylaw 1385, 2006 which proposes to change the Official Community Plan designation of That Part of DL 150 Shown on Amended Plan B1064 (DD 257637F), KDYD, Except: Plans 6200 and 17523 and Part Outlined Red on Plan B6558 located at 142 Princess Avenue from Country Residential and Residential Low Density to Residential Medium Density and Residential Low Density as shown on Schedule A be given 1st Reading;
AND THAT Zoning Amendment Bylaw 1386, 2006 which proposes to rezone That Part of DL 150 Shown on Amended Plan B1064 (DD 257637F), KDYD, Except Plans 6200 and 17523 and Part Outlined Red on Plan B6558 located at 142 Princess Avenue from the Country Residential Zone (C.R) to the Residential Apartment and Multi-Family Zone (R.3) and the Residential Single Family Zone (R.1) as shown on Schedule A be given 1st Reading;
AND THAT 2nd Reading and referral to Public Hearing of Bylaws 1385 and 1386 be withheld pending receipt of the following information:
- Dimensioned site plans for the proposed single and multi-family areas;
- A contour map drawn to the same scale as the above noted site plans;
- Maps showing the grades and cut and fill lines for the roads and driveways in the proposed single and multi-family areas;
- An assessment by a qualified professional which concludes that the slopes on the subject property can accommodate the proposed development and that there will be no detrimental impact on adjacent lands or the proposed development.;
AND THAT Final Adoption of Bylaws 1385 and 1386 be withheld until servicing issues have been dealt with to the satisfaction of the City of Enderby.

Councillor Ludwig attended an Emergency Social Services bar-b-que.
Councillor Shipmaker
- Councillor Shipmaker announced that he and Area F Alternate Director Bob Cowan have been appointed to the Enderby/Area F Services Committee.
- A meeting is being scheduled for September regarding the future direction for parks and recreation in the area. Input is requested to determine what level of service is to be provided.
- The Animal Control contract is coming due January 31, 2006. Input is requested prior to a decision being made whether to renew the contract.

Mayor Phillips reported that the Communities in Bloom judges were in town. Enderby is one of 5 communities being judged nationally in our category. The comments of the judges were very encouraging.

PUBLIC QUESTION PERIOD
Richard Vetter questioned why Enderby does not have a Board of Variance when the Community Charter clearly states that one is necessary.
Mayor Phillips informed Mr. Vetter that there is a Board of Variance in place.
