Mayor Phillips announced that the item of correspondence from the Minister of Human Resources re: Income Assistance Time Limits will be deleted from the agenda as it has already been dealt with by Council.

City of Enderby Zoning Amendment Bylaw No. 1341, 2004

Casey and Barbara Van Koevering — Lot 1, Plan 33533, Sec 26, Township 18, K.D.Y.D.

The City Planner outlined the request of the property owner and read a statement from The Public Works Superintendent indicating that the easement on the property is no longer required, and further that the development will be subject to the City of Enderby Subdivision Servicing and Development Bylaw No. 1278, 2000.

Moved by Councillor van Berkel, seconded by Councillor Wejr that City of Enderby Zoning Amendment Bylaw No. 1341, 2004 be given First and Second reading and referred to Public Hearing subject to cancellation of the Right of Way owned by the City of Enderby shown as lot 1, Plan B6147 and registered on title of the subject property as 39704E 1948-10-28.

DEVELOPMENT APPLICATIONS

Development Variance Permit Application No. 04-0032-END-DVP

Re: Gardner and Ellen Shaw (Volk Construction)

The Planner provided background information on an unintentional error that created the need for this permit.

Staff read a letter received February 2, 2004 from Sheila William of 907 Stanley stating no objection to application for variance.

Moved by Councillor Ludwig, seconded by Councillor Vetter that the Development Variance Permit for Lot 1, Plan KAP48242, Sec 26, Township 18, Range 9, Meridian 6, K.D.Y.D. to vary the setback from Cliffview Drive pursuant to Section 702.10.a of the City of Enderby Zoning Bylaw No. 966, 1987 from 5 metres to 4.17 metres for construction of a single family dwelling be approved.

Re: Community Charter — Conduct and Responsibilities of Elected Officials

The Administrator explained briefly the "disclosure of contracts" and the increased responsibilities of elected officials to disclose business dealings that may involve the City.

Re: Transit Service

Moved by Councillor Wejr, seconded by Councillor Vetter that the City of Enderby add a commuter run to Vernon in addition to existing service, plus service to Salmon Arm one day per week, with service to be reviewed one year from implementation.

Re: Fire Inspection

Discussion:

Moved by Councillor Wejr, seconded by Councillor van Berkel that the annual inspection frequency for occupancies classed as "Assembly" and "Hotels, Motels, Apartments" be reduced from twice per year to once per year;

AND FURTHER that staff investigate the implementation of re-inspection fines;

AND FURTHER that staff investigate optional fire inspection/investigation service providers.

PUBLIC QUESTION PERIOD

Duncan Walker of 813 Regent Avenue expressed concern that welfare cuts may result in increased vandalism. He asked what action Council is taking and what the number of effected persons were for Enderby.

Mayor Phillips offered to share the information that Council has received from the Ministry of Human resources relating to the topic of Time Limits on Income Assistance.

ADJOURNMENT

On a motion by Councillor Wejr, the regular meeting adjourned at 9:10 p.m.
