Discussion:

• C.P.R. had not registered concerns regarding other developments near the railway.
• There is a roadway between the property and railroad tracks.
• If endowment required for parks, it would result in no parkland.
• Approval would allow City to take advantage of infrastructure being extended at Developer’s expense.
• Proposal goes against the principles of Official Community Planning. Urban sprawl should not be encouraged.
• Residential use and creation of parkland is a more desirable use than industrial.

The Planner provided background information on an unintentional error that created the need for this permit.

Staff read a letter received February 2, 2004 from Sheila William of 907 Stanley stating no objection to application for variance.

Re: Regional Air Quality Function

Discussion:

• Previous Council agreed to participate subject to costs not exceeding $40,000 in 2002 and dropping to $12,000 is subsequent years. The proposed budget for 2004 indicates a cost of $36,189.
• Council’s previous participation was subject to participation from senior levels of government.
• There is no indication of revenue from bylaw enforcement.

• Central and South Okanagan has an air quality function.
• Readings from monitor on Fire Hall roof are not known.

• Councillor van Berkel attended an informational meeting with School District representatives to discuss possibilities for joint sue agreements.
• A report has been received from M.V. Beattie School regarding Knight Street crossing. It was noted that there has not been correspondence from the Ministry of Transportation for some time.

• Councillor Ludwig attended a B. C. Transit meeting. Detailed report enclosed.

• Councillor Wejr attended a Health Co-Op meeting. They have changed their name to Enderby Memorial Co-Operative. Registration as a legal entity should be complete shortly.
• Councillor Wejr attended a Centennial meeting. Events are being planned for the week of July 29 — August 7. The next meeting is February 19.

• Mayor Phillips attended M. V. Beattie school with Councillor van Berkel to discuss their roles in municipal government with grade three students.

Re: Community Charter — Conduct and Responsibilities of Elected Officials

The Administrator explained briefly the "disclosure of contracts" and the increased responsibilities of elected officials to disclose business dealings that may involve the City.

Re: Transit Service

• Having both commuter service to Vernon plus 1 day service per week to Salmon Arm will cost an additional $3,980. ($2.68 per average residential assessment)
• Commuter run to Vernon could be implemented quickly. Salmon Arm service could take longer due to 2 Regional Districts being involved.
• Director Tuominen willing to commit the Area F share costs associated with Options 1, 3 or 4 as outlined in the memo.
• Implementation on a trial basis
• Once service is expanded, it will be difficult to discontinue.

Moved by Councillor Wejr, seconded by Councillor Vetter that the City of Enderby add a commuter run to Vernon in addition to existing service, plus service to Salmon Arm one day per week, with service to be reviewed one year from implementation.

Re: Fire Inspection

Discussion:

• Fine system may be incentive for earlier compliance, thereby decreasing time spent on re-inspection.
• NORD has been requested to supply a report of the sites visited and time spent on inspections in the future.

Moved by Councillor Wejr, seconded by Councillor van Berkel that the annual inspection frequency for occupancies classed as "Assembly" and "Hotels, Motels, Apartments" be reduced from twice per year to once per year;

AND FURTHER that staff investigate the implementation of re-inspection fines;

AND FURTHER that staff investigate optional fire inspection/investigation service providers.

Duncan Walker of 813 Regent Avenue expressed concern that welfare cuts may result in increased vandalism. He asked what action Council is taking and what the number of effected persons were for Enderby.

Mayor Phillips offered to share the information that Council has received from the Ministry of Human resources relating to the topic of Time Limits on Income Assistance.

On a motion by Councillor Wejr, the regular meeting adjourned at 9:10 p.m.
