Regular Minutes of January 24, 2005

Moved by Councillor Brookes, seconded by Councillor Wejr that the minutes of the Regular Meeting of January 24, 2005 be adopted as circulated.

BUSINESS ARISING FROM THE MINUTES AND/OR UNFINISHED BUSINESS

Fire Protection Service Area Extension

The Administrator reported to Council that the two properties to the west of the Oxbow Subdivision, which were under consideration for inclusion in the boundary extension, do not have easy access. It therefore would not be advisable to include these properties in the service area.

BYLAWS – 3rd Reading and Adoption

Zoning Text Amendment Bylaw No. 1357, 2005

Moved by Councillor Wejr, seconded by Councillor Ludwig that Zoning Text Amendment No. 1357, 2005 be read a third time, reconsidered and adopted.

Land Use Amendment Bylaw No. 1355, 2005

Moved by Councillor Wejr, seconded by Councillor Brookes that Land Use Amendment Bylaw No. 1355, 2005 be reconsidered and adopted.

REPORTS

Councillor van Berkel

… Attended a Success by Six meeting. There is $20,000 in grant funds expected.

Councillor Wejr

… Attended an Emergency Joint Executive Committee meeting. A review of the draft Emergency Plan was conducted. Councillor Wejr commended the Administrators of each municipality for the efforts put into the development of the plan thus far.
… Attended the Grand Opening of the Enderby Community Health Centre. It was satisfying to see the project come to fruition after all the efforts made.

Councillor Brookes

… Attended the snow sculpting competitions at Silver Star Resort with local team attaining both First Place and People’s Choice award for a second year in a row.

Moved by Councillor Brookes, seconded by Councillor van Berkel that the report be received and filed.

NEW BUSINESS

Sidewalk Inspection

The Administrator reported that this policy would replace the existing policy. Inspections would be conducted on an annual basis by the Public Works Superintendent, who would then make recommendations to Council.

Discussion:
… The rating scale of defects and priority does not clearly indicate the amount of traffic use.
… It was suggested that perhaps a number scale (1, 2, 3) for the condition of the sidewalk, followed by a letter L (low), M (medium), H (high) indicating the amount of use would more adequately indicate the condition of the sidewalk.
… The inclusion of budgetary constraints in the policy is key to protect the city from liability exposure.

It was the consensus of Council that the policy requires clarification before being adopted.

Moved by Councillor Brookes, seconded by Councillor van Berkel that the Sidewalk Inspection Policy be re-worked by staff prior to presentation to Council.

Memo from Administrator – Riparian Area Regulation

Moved by Councillor Ludwig, seconded by Councillor Brookes that Council endorse the recommendation of the City of Burnaby that the Minister of Water, Land and Air Protection extend the date that the Riparian Area Regulation comes into effect from March 31, 2005 to December 31, 2005.

Memo from Treasurer – Public Sector Accounting - Changes Mandated by the Canadian Institute of Chartered Accountants

Discussion: It is unlikely that the City would encounter all items listed at one time. There have been funds accrued to protect the City in the event that one or more of these events occurs. The auditors will advise if the amount being accrued is considered adequate.

2005 Pitch-In Canada Week

Discussion: There are several local initiatives that are in place already to clean up the City. Staff were requested to clarify the requirements for disclosure vs. accrual.

UBCM – Member Notice – Federal Appeal Court Ruling – PSAC vs Municipal RCMP Employees

The Administrator outlined the economic impact of the recent ruling by the Federal Court of Appeal. Municipalities, while being responsible for paying for RCMP staff, will have no part in collective bargaining process or control of wages paid should these employees fall under federal labour law.

Moved by Councillor Shipmaker, seconded by Councillor van Berkel that the correspondence be received and filed.

CLOSED MEEETING RESOLUTION

Moved by Councillor Ludwig, seconded by Councillor Brookes that Council hold a meeting closed to the public in order to discuss one or more topics under Section 90 of the Community Charter.
