Minutes of a Public Hearing held on Monday, February 2, 2004 at 7:00 p.m. in the Council Chambers of City Hall.

Mayor Phillips read the rules of procedure for the evenings public hearings.
Mayor Phillips introduced the following bylaws:
City of Enderby Official Community Plan Amendment Bylaw No. 1337, 2004
This Bylaw proposes to amend the Official Community Plan marked Schedule "B", attached and forming part of The City of Enderby Official Community Plan Bylaw No. 1171, 1995 by changing the designation of Lot 1, Section 26, Township 18, Range 9, W6M, K.D.Y.D., Plan KAP67097, 116 Salmon Arm Road from Residential Low Density to Residential Medium Density to allow for the conversion from a two family dwelling to a three family dwelling.

City of Enderby Zoning Amendment Bylaw No. 1338, 2004
This bylaw proposes to rezone Lot 1, Section 26, Township 18, Range 9, W6M, K.D.Y.D., Plan KAP67097, 116 Salmon Arm Road from Residential Two Family (R.2) to Residential Apartment and Multi-Family Zone (R.3), which rezoning would permit the conversion from a two family dwelling to a three family dwelling.
Mayor Phillips invited comment from the public regarding the above noted bylaws.
Jody Kallis of 115 Norleen Lane read a letter in opposition to the proposal signed by Jody Kallis and Randy Kallis of 115 Norleen Lane, Norleen Litzenberger and Pete Litzenberger of 116 Norleen Lane and Kerry Fox and Colleen Fox of 106 Norleen Lane.
Randy Kallis of 115 Norleen Lane read a letter in opposition to the proposal from Marian Jerse of 114 Salmon Arm Drive.
Clay Hett of 311 Glenmary Road, introduced fellow property owner Marilyn Livingstone, and stated the following:

Cora Prevost of ReMax Enderby dated February 2, 2004 in support of the proposal.
Clay Hett and Marilyn Livingstone in support of their application.
Staff read the following comments from the Public Works Superintendent :
" Substantial off-road parking improvements required including paved driveway. The access to this property from Salmon Arm Drive is quite steep and deposits a lot of driveway debris on the pedestrian bike path and walkway. Separate water and sewer services to the detached dwelling is required."
There were no further comments or submissions relating to the above noted bylaws.

This Bylaw proposes to amend the Official Community Plan marked Schedule "B", attached and forming part of The City of Enderby Official Community Plan Bylaw No. 1171, 1995 by changing the designation of Lot 3, Plan 1593, except Plan B5731; Part Block 3, Plan 1593, Plan B5731; Parcel A, shown on Plan 1593, Block 2, Plan N5872; Lot 2, D.L. 226, Plan 1593, except Plans B5872 and B6868; Lot A, D.L. 226, Plan 6122, all in Section 35, Township 18, K.D.Y.D. 275, 305, 321, 327 and 335 Brickyard Road from Industrial Park to Residential Medium Density and Park to allow for mixed residential and park use.

This bylaw proposes to rezone Lot 3, Plan 1593, except Plan B5731; Part Block 3, Plan 1593, Plan B5731; Parcel A, shown on Plan 1593, Block 2, Plan N5872; Lot 2, D.L. 226, Plan 1593, except Plans B5872 and B6868; Lot A, D.L. 226, Plan 6122, all in Section 35, Township 18, K.D.Y.D. 275, 305, 321, 327 and 335 Brickyard Road from Industrial Park (I-3) to Residential Apartment and Multi-Family Zone (R-3), which rezoning would allow mixed residential and park use.
Mayor Phillips invited comment from the public regarding the above noted bylaws.

Staff read the following letters:
Canadian Pacific Railway dated January 28, 2004 opposing proposal with a request for conditions should the proposal be approved.
Staff read the following comments from the Public Works Superintendent:
"As you are aware, this area requires all infrastructure including a complete road upgrade. It this area is to be developed, all the infrastructure cost outlined in the Citys Subdivision Servicing and Development Bylaw No. 1278, 2000 including water and sewer main extensions to the City systems should be at the developers expense. The City of Enderby currently has a large storm sewer main that runs through this property. This main drains the northern area of the City west of Highway 97."
