Moved by Councillor Cyr, seconded Councillor Case that Council approve the issuance of a Development Variance Permit for the property legally described as Lot 5, Block 7, DL 150, K (formerly 0) DYD, Plan 211A located at 720 Cliff Avenue to vary the following:

- Section 702.10(e) of the City of Enderby Zoning Bylaw No. 966, 1987 by reducing the side yard setback for an addition to a single family dwelling from 1.5 metres to 0.6 metres as shown on Schedule “A”;

AND THAT issuance of the Development Variance Permit be subject to issuance of a Heritage Alteration Permit for the form and character of the proposed building addition.

Moved by Councillor Ludwig, seconded by Councillor Wejr that Council approve the issuance of a Development Variance Permit for the property legally described as Lot A, Section 26, Township 18, Range 9, W6M, KDYD, Plan KAP78108 except Plan KAP78763 located at 146 Cliffview Drive to vary the following:

- Table 2.3.2 of Schedule 'A' of the City of Enderby Subdivision Servicing and Development Bylaw No. 1278, 2000 by reducing the pavement width for a local road from 18 metres to 14 metres and the radius of a cul de sac bulb right of way from 18 metres to 15 metres.

Applicant: Layston Developments Corp.

The Planner introduced changes proposed to the Development Permit approved May 16, 2005. The changes are in keeping with the conditions of the permit. The building façade and additional landscaping facing George Street will enhance the appearance of the property.

Moved by Councillor Shipmaker, seconded Councillor Wejr that Development Permit No. 05-0240-END-DP be amended by deleting schedules “A” and “B-3” and substituting revised Schedules “A” and “B-3” thereof.

Roads - MRIF Application

The Administrator reported that the City's application has been referred to the Ministry of Economic Development and the Ministry of Transportation. The Ministry of Transportation has determined that the project does not fit in with the Highway 97A Access Plan.

Moved by Councillor Case, seconded by Councillor Ludwig that the City of Enderby's Road Improvement Project No. 17353 for funding under the Canada-British Columbia Municipal Rural Infrastructure Program be revised to complement and correspond with the concept plans of the Ministry of Transportation.

BYLAWS

City of Enderby Tax Prepayment Plan Bylaw No. 1400, 2007

Moved by Councillor Cyr, seconded by Councillor Vetter that City of Enderby Tax Prepayment Plan Bylaw No. 1400, 2007 be introduced and read a first time by title only and carried through to three readings.

REPORTS

Councillor Wejr

Councillor Wejr reported the following items from the Enderby/Area F Services Committee meeting of June 11, 2007:
- Youth group request to have volleyball nets moved from Riverside Park to Tuey Park;
- Letter to be forwarded to baseball leagues reminding them of equipment policy.

Moved by Councillor Cyr, seconded by Councillor Vetter that a recommendation from Council be forwarded to the Enderby/Area F Services Committee and Recreation Excellence suggesting that the men's leagues play be restricted to the Legionnaires ball diamond.

Councillor Ludwig

Councillor Ludwig attended the following meetings:
- Success by Six
- RCMP meeting with Council
- Open House dealing with Secondary Suites

Councillor Shipmaker

Councillor Shipmaker suggested that Councillors visit the Village of Nakusp website.

Mayor Phillips

- Southern Interior Development Initiative Trust (SIDIT) website has been upgraded to include application guidelines and forms. SIDIT is now positioned to invite proposals and to support economic development in the Southern Interior.
- Attended the Local Government Leadership Academy in Richmond, B. C. last week. There were 140 delegates in attendance and 72 contributing UBCM members. There were opportunities for networking. Rex Murphy was one of the keynote speakers.

Deborah Burr - E-mail dated June 4, 2007
Re: Open Burning in the City Centre

Discussion:
- Costly to remove large brush piles when developing property;
- Consideration for collecting a bond from developers should the City incur expenses relating to a burn;
- Burning bylaw is under review;
- Valuable urban interface fire training for the Fire Department;
- Venting index at time of burn was acceptable.

Moved by Councillor Cyr, seconded by Councillor Ludwig that a letter be forwarded to Deborah Burr acknowledging her concern and advising that conditions were optimum, valuable training was obtained, and that a review of the City's burning bylaw is underway.

Tangible Capital Assets - Memo dated June 12, 2007

The Administrator reported that there will be more information, in the form of terms of reference, available in the fall from the Government Finance Officers Association of B. C. It may be premature to engage a consultant until additional information is available. There is currently grant funding available.

Moved by Councillor Ludwig, seconded by Councillor Vetter that staff apply for the maximum available under Provincial Infrastructure Planning Grant Program.

Cities for Children

Councillor Ludwig expressed an interest in attending a summit “Cities for Children” addressing early childhood development. Additional details of the summit will be available in August.

Moved by Councillor Vetter, seconded by Councillor Case that Council authorize Councillor Ludwig to attend the “Cities for Children” Summit in Kelowna on November 1st and 2nd.

Policing

Councillor Cyr wished to assure the public that Council is working closely with the RCMP to address the concerns about local policing issues.

PUBLIC QUESTION PERIOD

Jackie Pearase of the North Valley Echo questioned why the Ministry has an issue with the planned upgrades to Stanley Avenue. The Administrator explained that the concept plan from the Ministry of Transportation includes a raised median at Stanley Avenue. The application will be modified to divert traffic from Stanley at Sicamous Street to Mill Avenue where a traffic light is planned. This modification to the application is not expected to impact costs.

CLOSED MEETING RESOLUTION

Moved by Councillor Case, seconded by Councillor Cyr that Council hold a meeting closed to the public in order to discuss one or more topics under Section 90 of the Community Charter.
