Questions were raised with respect to the opportunities for the concerns raised at the Public Hearing to be addressed, as well as opportunities for further review by Council.
Staff responded as follows:
- The requirements of the Subdivision Servicing and Development Bylaw will have to be met prior to final subdivision approval, however, the Bylaw does not impose requirements for buffering;
- Council would not have an opportunity for further input or to receive further information unless adoption of the bylaws is withheld pending receipt of further information or if development variances are required;
- Should variances be applied for, Council and adjacent land owners would have the opportunity for further input, but only with respect to the specific variances requested.

Okanagan Valley Railway - Correspondence dated April 18, 2007
Re: Railway Line Maintenance
The Mayor and Administrator met with the General Manager of Okanagan Valley Railway. Surfacing of railway crossings is the responsibility of the City. One year's advance notice to the Railway is required. Concrete or rubber are the preferred materials to use for increased longevity and should be considered during budget deliberations.

The Administrator advised as follows:
- A revised site plan had been received from the applicants on May 1, 2007 and a revised PLR had been issued by the Approving Officer the following day;
- The Planner will now review the Development Variance Permit Application in relation to the revised PLR;
- There is a possibility that additional letters may need to be issued to adjacent land owners;
- Every attempt will be made to present an updated report to Council on May 22, 2007;
- Option of scheduling a Committee-of-the-Whole meeting prior to the Council meeting

Canada - British Columbia Municipal Rural Infrastructure Funding Application - Roads
The Administrator reported that additional information has been asked for and increased costs, particularly aggregate, has resulted in a need to amend the application by adding 15% to the budget , thus increasing the local share to $688,000. An alternate option would be to leave the application as submitted and reduce the amount of work to be done.
Moved by Councillor Ludwig, seconded by Councillor Wejr that, due to increasing construction costs, the City of Enderby's application for Canada-British Columbia-Rural Infrastructure Fund Road Project #17353 for road improvements including sidewalk, curb and gutter on Cliffview Drive (including a traffic roundabout) Johnston Avenue and Stanley Avenue, as well as a greenhouse gas target emission study if required, be amended to reflect a total eligible project cost of $2,064,548.00, with the City's share of eligible project costs to be funded from the following sources:
Roads Capital Reserve 175,165
General Capital Reserve 224,524
Roads Capital Budget (2007 & 2008) 140,000
Sidewalk Improvement Budget (2007 & 2008) 70,000
Transfer from Surplus 78,494
Total local share of eligible project costs $688,183
AND FURTHER THAT the following ineligible costs be funded from the following sources:

REPORTS
Councillor Case
- Attended OMMA convention. There were good speakers, particularly the Premier's address which was motivational rather than political.
- Funtastic group is about to start work on the Legionnaire's ball diamond at Riverside Park which will allow for both baseball and slow pitch.
Councillor Wejr
- Official Opening of the Mabel Lake Boat Launch will take place on Friday, May 11th at 3:30 pm.
Councillor Cyr
- Youth Advisory Working Group met this evening. Youth have made enquiries about updating the skateboard park and having volleyball nets installed at Waterwheel Park. Their comments will be forwarded to the Enderby/Area F Services Committee for consideration. The next meeting is scheduled for 5:00 pm on May 22nd.
- Twice but Nice has donated $2,000 for furniture for the palliative care room and has expressed a willingness to fund the monthly expenses associated with the room (ie: cable, telephone).
Councillor Vetter
- Attended the OMMA convention. The Convention committee and the City of Merritt does a good job with their town theme and demonstrate community pride. Hopefully Enderby can do the same with a theme.
Councillor Ludwig
- Attended a Success by Six luncheon.
- Attended OMMA convention and enjoyed the speakers: Premier Gordon Campbell, political columnist Michael Smyth and motivational speaker Terry Small.
- Osoyoos is getting back into horse racing and is seeking support.
Mayor Phillips
Enderby Community Health Centre Report:
- Interior Health has included funding for 2007-08 into their budget, demonstrating their commitment to the Health Centre and improving the financial outlook for the facility.
- CHC Manager Doug Blackie made presentations about the Centre to the Kingfisher Community Society and Armstrong Rotary Club. He has accepted an invitation to make a presentation at the annual meeting of the Mara Community Association.
- A team of health science students will again be assigned to the Centre under the InterProfessional Rural Program of BC. The students will work with clinical supervisors and on special projects.
- Allison Rankin and Wayne Senner will take part in the Physician Support Program.
OMMA Convention:
- Last year for OMMA. Name will officially change to SILGA (Southern Interior Local Government Association).
- New executive was elected.
- Excellent keynote speakers.
- Merritt treated delegates to mini Mountain Music Festival - very enjoyable.
- Next year's conference to be held in Vernon.
- Attended a SIDIT (Southern Interior Development Initiative Trust) meeting. Hoping to be able to accept applications by mid 2007. Funding parameters are from $25,000 to under $1,000,000.
Administrator
- The Administrator reported that work will commence later this week to deal with the drainage issues on Old Vernon St. and part of Cliff Avenue.
- An e-mail was read from a Chase resident commending Enderby for the lovely flowers along the highway, particularly the daffodils.

WHEREAS Canada has yet to properly honour, in a suitable location that is always accessible to the public, the NAMES of ALL of OUR FALLEN in wars and peacekeeping;
AND WHEREAS over 115, 000 Fallen have their graves in seventy-three countries and hundreds of cemeteries;
AND WHEREAS their remains, by law, cannot be repatriated to Canada;
AND WHEREAS we must create a suitable national shrine to our fallen;
AND WHEREAS proper recognition will show our gratitude and respect for their sacrifices;
THEREFORE BE IT RESOLVED THAT the Council of the City of Enderby request that the Government of Canada enact Private Members Bill C-417, the Canadian Soldiers' and Peacekeepers' Memorial Wall Act.

PUBLIC QUESTION PERIOD
Margot Ludwig of 132 West Enderby Road questioned why their Development Variance Permit has been postponed when all conditions have been met. She does not agree that the application needs to be reviewed again by the Planner since the Approving Officer has not such in his correspondence to them. It was explained that based on the date the documents were received, they have been processed in a timely manner, and will go through the applicable processing channels. Once the Planner determines whether or not there are changes requiring adjacent landowner notification, the application will then come back to Council.
Ms. Ludwig expressed that her correspondence regarding legal opinions should not impact the processing of the variance permit application.
