DELEGATIONS
Don Nettleton, Financial Manager
Re: Okanagan Regional Library Annual Report
A power-point presentation was given by Mr. Neddleton. The focus of the presentation was the expanding services being made available at the libraries. The following are highlights of the presentation:
- Technological Improvements to computer services;
- Changes to the traditional measurement of usage due to increased electronic services being utilized;
- Challenge of replacement of retiring staff members;
- List of popular databases now available at libraries;
- Improved province-wide initiatives including a manned reference service, one card permitting borrowing and returning of materials at any participating library, and providing a library card to ever school child;
- Okanagan Regional Library per capita expenditure is almost 20% below the provincial average.
- Long term financial plan projects tax increase of $1.00 - $2.00 per residence per year - 2008 will likely be at the higher end of that range.
Mr. Nettleton commented that the Enderby branch continues to be well used and receives positive feedback. Appreciation was expressed for the funding recently received for furnishings.
Upon question, Mr. Nettleton expressed doubt as to whether the Enderby branch would be extending their hours of operation. They are awaiting statistics from the latest census and expect to address operating hours by 2009. Those branches with exceptional growth will likely expand their hours.
BYLAWS - 3rd Reading
City of Enderby Official Community Plan Bylaw No. 1171, 1995 Amendment Bylaw No. 1402, 2007
Changing the future land use designation of Lot 3, DL 150, K(formerly O)DYD, Plan 20301, located at 407 Kildonan Avenue from Residential Low Density to Residential Medium Density to allow for the construction of apartment housing.
Applicant: Alfonso de Vega
Discussions:
- Development Permit and Development Variance Permit application have been submitted;
- The developer has indicated that the units are intended to be strata units;
- Council does not have ability to control whether units are rented by individual owners, but can address form and character of the development through the Development Permit which is a prerequisite to development.

2008 Tax Exemption Bylaw No. 1404, 2007
Moved by Councillor Cyr, seconded by Councillor Ludwig that 2008 Tax Exemption Bylaw No. 1404, 2007 be introduced and read a first time by title only and carried through to three readings.

BYLAWS - 1st and 2nd Reading
Zoning Bylaw No. 966, 1987 Amendment Bylaw No. 1405, 2007
A Bylaw to Identify Secondary Suites as a Permitted Use in the R.1 and R.1A Zones
The Planner re-introduced the bylaw and reported on the results of the public review process.
The Administrator read aloud the definitions and conditions related to permitted secondary suites.
Moved by Councillor Cyr, seconded by Councillor Ludwig that the City of Enderby Zoning Bylaw No. 966, 1987 Amendment Bylaw No, 1405, 2007 which identifies secondary suites as a permitted use in both the Residential Single Family (R.1) and the Residential Single Family (R.1-A) zones of the City of Enderby Zoning Bylaw No. 966, 1987 be given first and second reading and be referred to Public Hearing;
AND THAT prior to Final Adoption of the City of Enderby Zoning Bylaw No. 966, 1987 Amendment Bylaw No. 1405, 2007:
- the City's Water, Sanitary Sewer and Refuse Rates Bylaws be amended so that single family dwellings with suites are charged a rate of 1.4 times the rate charged to single family dwellings without suites;
- an information sheet be developed to help raise awareness amongst homeowners, tenants and other stakeholders of how the secondary suite program works;
AND THAT funds be set aside in the 2008 budget to cover costs associated with:
- the City providing free advise to owners of existing secondary suites on what upgrading works would need to be done to ensure the suite meets BC Building Code requirements;
- investigating complaints about illegal secondary suites and filing court injunctions to require the removal of illegal suites that do not meet BC Building Code safety and health standards.

REPORTS
Councillor Case
Councillor Case reported the following from the Chamber of Commerce:
- income is on target with budget;
- new caretaker is being sought for the RV Park. The Chamber of Commerce may be approaching the City for assistance with winter maintenance until the caretaker position is filled;
- the Economic Development committee is working on the following projects: developing a tag line for Enderby, having the 2010 Olympic Torch Relay pass through Enderby, BC River Days.
Councillor Case reported that the students at AL Fortune School have offered to transfer City bylaws onto the City website free of charge. The students have also offered to help clean up the park.
Councillor Wejr
Councillor Wejr attended the UBCM Convention and reported the following:
Regional District sessions:
- Met with Minister of Community Services and the Premier re: Governance
- Met with Minister of Agriculture and Lands re: meat processing
- Met with Minister of Public Safety and Solicitor General re: Victims Assistance
Representing the Enderby Memorial Co-OP, Councillor Wejr also:
- Met with George Abbott, MLA re: assisted living
- Discussed assisted living with BC Housing at the trade show.
Councillor Cyr
Councillor Cyr attended the UBCM Convention and reported on the following sessions:
- Community Funding workshop;
- Justice Reform: civil and family law. Community courts will be a vision of the future;
- Asset Building Workshop: healthy communities (crime and addiction);
- Working with First Nations
- RCMP (BC/Yukon)
Councillor Ludwig
Councillor Ludwig attended the UBCM Convention and reported on the following sessions:
- TILMA workshop;
- Bylaw enforcement;
- Single Business License initiative;
- Minister of Transportation;
- Minister of Health
Councillor Ludwig found the idea of a floating walkway interesting and worthy of consideration should the Riverwalk be extended in the future.
Councillor Shipmaker
Councillor Shipmaker reported that an individual contacted him offering names and phone numbers of known drug dealers. The individual backed out of a meeting however.
Councillor Shipmaker extended apologies to Margo Ludwig re: volleyball nets that are not yet in place at Tuey Park.
Mayor Phillips
Mayor Phillips displayed the 20 year membership plaque that was presented to the City from the Municipal Insurance Association.
Mayor Phillips attended the UBCM Convention and reported on the following sessions:
- TILMA - Province claims misinformation is circulating; Lidstone Young Anderson stated that impact will not be known until the end of the consultation process;
- Ministry of Transportation - Province stated that funds from Federal Government are holding up the project. A meeting, to review the business case for highway access improvements in Enderby will be held in October.
- Small Talk Forum - LGMA Internship Program.
Administrator
The Administrator reported as follows:
Local Government Management Internship Program - she had submitted an application under the internship program, a partnership between the Local Government Management Association, the Municipal Finance Authority and the Ministry of Community Services. The application, along with related materials, would be included in the October 15, 2007 Council agenda for ratification.
Single Business Licensing Initiative - the Province had taken a step back and narrowed the scope of the initiative, at least on a temporary basis. A pilot project, building on the existing inter-municipal business license program in the North Okanagan, is to be undertaken in the Okanagan and Similkameen for mobile vendors such as builders, and will not include storefront operations.
Tangible Capital Assets - The Government Finance Officers Association of B. C., with funding from the Ministry of Community Services, has developed a manual and will be conducting training sessions. The Treasurer will be attending the training session in Kamloops at the end of October.
Local Government Grant Funding - The Administrator attended the UBCM workshop relating to grant funding. The second half of the workshop provided an opportunity for attendees to meet briefly with representatives of various funding agencies, providing an opportunity to bring attention to the frustrations experienced by applicants due to delays in funding announcements. Specifically, it was requested that when an application is no longer under consideration, the local government should be advised in order to carry on with business. In the case of Enderby, almost all reserve and surplus funds have been earmarked since January for the share of grant projects. If the City were aware of which applications have already been weeded out, it could put those monies to good use.
The Administrator further advised that additional information regarding the City's Roads MRIF application had been requested and provided today.
The Administrator reminded Council of the Budgeting and Goals session, open to all local elected officials, scheduled for Wednesday and Thursday evenings at the NORD office. An agenda will be circulated tomorrow with a full package distributed at the meeting. Councillor Wejr and Mayor Phillips indicated that they would be attending.

Moved by Councillor Wejr, seconded by Councillor Ludwig that Council give notice of its intent to approve the following variances to the City of Enderby Subdivision Servicing and Development Bylaw No. 1278, 2000:
- Vary Section 3.22.g of Schedule A by waiving the requirement to construct a 150mm water main from the intersection of West Enderby Road to the end of unnamed road;
- Vary Section 5.2.6 of Schedule A by waiving the width of requirement of the storm right of way from 5m to 4m.
AND FURTHER that the variance to eliminate the installation of a fire hydrant be denied.

Regional District of North Okanagan - Correspondence dated September 17, 2007
Re: Regional West Nile Virus Prevention Plan
Moved by Councillor Case, seconded by Councillor Wejr that where 100% funding is available from senior levels of government, Council is supportive of developing and implementing a Regional West Nile Virus Prevention Plan that is approved by all Member Municipalities and Electoral Areas that includes identification of mosquito habitat sites, mapping and identification of potential vector species, and specific management initiatives including costs for each, as well as cooperating as soon as possible with the Province to prevent West Nile Virus from impacting citizens in the Regional District of North Okanagan.

Re: Request to Purchase Bench for Riverwalk
The Administrator stated that there have been a number of similar requests of late and she cautions against getting into the business of making and selling benches. Although the forms are owned by the City, staff no longer has the services of the contractor who previously made the benches.
Moved by Councillor Shipmaker, seconded by Councillor Case that the request of Frankie Ulmer to purchase a bench be accommodated provided it can be done so without impacting Public Works staff.

Council requested that a letter be sent to Frankie Ulmer stating that Council is in agreement to sell a bench at such time as a contractor is in place to pour the concrete.

UBCM - The British Columbia Climate Action Charter
Discussion:
This item was received for information on September 17, 2007. A strong message was delivered during the UBCM Convention that warrants a closer look the proposal. Future funding opportunities may be impacted by inclusion in the Charter.
Moved by Councillor Wejr, seconded by Councillor Case that the City of Enderby show its commitment to the goals and other aspects of the Charter by signing on to the British Columbia Climate Action Charter.

Governance
Discussions:
- Province is considering different governance models for the Okanagan valley;
- Several scenarios being discussed, including one regional district for entire Okanagan, formation of district municipalities, amalgamation of existing municipalities;
- Local identity is at risk;
- NORD Administrator, along with Administrators and Chairs of the Central Okanagan and Okanagan-Similkameen, met with Premier, Minister Chong and Minister Thorpe during the UBCM convention;
- NORD Administrator will likely be preparing a report;
- Restructuring of Comox-Strathcona Regional District with no consultation with Board or public;
- City of Enderby, Area F and portions of other electoral areas within NORD forming part of the Fraser Basin watershed as opposed to the Okanagan Basin.
Moved by Councillor Cyr, seconded by Councillor Wejr that a letter be forwarded to the Premier and the Minister of Community Services requesting that the City be advised of the Province's reasons for considering governance restructuring and that no restructuring occur without full consultation with the affected local governments and citizens.
