Minutes of a Public Hearing held on Monday, May 2, 2005 at 7:00 p.m. in the Council Chambers of City Hall.

Mayor Phillips read the rules of procedure for the evenings public hearing.
Mayor Phillips introduced the following bylaw:
Zoning Amendment Bylaw No. 1361, 2005
Lot 2, Section 27, TWP 18, Range 9 West of the 6th Meridian, KDYD, Plan KAP46537 222 Salmon Arm Drive
From Country Residential (C.R) to Residential Single Family (R1.A) Zone
The Administrator read a written submission from Willy and Wendy Schultz of 32 Preston Crescent which was received following the last Public Hearing.
The Administrator then explained the reasons for the Second Public Hearing being called. Comments were made which said that the Citys bylaws would not permit access to the property from Gunter Ellison Road. Further investigation has revealed that such access may actually be possible. However, final access design would not be determined until completely reviewed through the subdivision approval process.
Members of the public were invited to make presentations to Council:
Kim Clifford, 33 Preston Crescent
Ms Clifford stated that she has had conversations with the Administrator since the last meeting and feels that the process is unfair. Access to the proposed development is the main concern of Preston Crescent residents. She feels that the neighbourhood is being affected by the process. She is not opposed to rezoning but feels it unfair that the residents have no further say in the layout of the subdivision. She appealed to Council to take the concerns of Preston Crescent residents into consideration during the subdivision process. She submitted a written statement to be entered into record.
Wilfred Fournier, 9 Preston Crescent
Mr. Fournier stated that road width was a consideration when he purchased his property. He was told that the road was built to accommodate the traffic generated by Preston Crescent residents. If access to the subject property is made from Preston Crescent, then he feels that the rules have either changed or he did not get truthful answers from City Hall 15 years ago. He also expressed his concerns for safety as a result of additional traffic volumes and appeals to Council to consider these concerns.
Barry Fawcett, 10 Preston Crescent
Mr. Fawcett commented that with vehicles parked on either side of the street, there is not adequate room for large vehicles to pass. Children playing on scooters and bikes cant be seen by traffic when cars are parked. The crescent and cul de sac is safe now, but with no sidewalks and added traffic, it will be dangerous. Mr. Fawcett also commented that vehicles coming from Gunter Ellison are travelling at high speed and there is no visibility when exiting Preston Crescent. He feels that Council needs to eliminate the hill which obstructs vision. By accessing the subject property from Gunter Ellison, at least the new residents would be protected. He was under the impression that a committee would make decisions on the subdivision but then discovered that it was the Administrator that will be making the decisions. He suggested that she take the time to visit the neighbourhood.
Will Richardson, 268 Gunter Ellison Rd.
Mr. Richardson stated that he is in support of the rezoning. He feels that Enderby needs new subdivisions to get better roads and services. He stated that growing in an orderly way with planned subdivisions is a positive thing and he would like to see more properly planned subdivisions.
Jim Macknee, 114 Timberlane Rd
Mr. Macknee, the applicant, is looking forward to working with the City. He has been advised of the recommendations and is concerned with the Preston Crescent group. He wants to work with them and to avoid friction. He feels that they need to work together as a community. He trusts that the issues will be worked out at the subdivision phase.
Frank Lucianovich, 103 Gunter Ellison Rd.
Mr. Lucianovich stated that often times stop signs and traffic lights are installed after a tragedy. Enderby is now in a position to act before a tragedy. If access to property is to be from Gunter Ellison, then speed needs to be addressed.
