APPROVAL OF AGENDA

Mayor Phillips added the following items to the agenda;

ADOPTION OF MINUTES

Regular Meeting of September 4, 2007

Moved by Councillor Cyr, seconded by Councillor Case that the minutes of the regular meeting of September 4, 2007 be adopted as circulated.

DELEGATIONS

Illegal Drugs and Associated Crime

Mr. Greg Robinson spoke on behalf of approximately 150 in attendance regarding drug manufacturing, distribution and addiction, as well as associated crime including theft, violence and prostitution. The delegation advised that immediate action must be taken to address the problem in the City of Enderby, as well as Electoral Area F of the Regional District of North Okanagan and the Splats'in First Nation.

Mayor Phillips advised that the City had recently adopted a property remediation bylaw that could be utilized to address properties used in connection with drugs.

Councillors expressed their appreciation of how the residents have come together to address the problem.

A Town Hall meeting was scheduled for 7:00 p.m. on Wednesday, September 19, 2007.

Mayor Phillips advised that she had arranged to meet with the RCMP and community representatives on October 2, 2007, and hoped that a number of interested citizens would join that group to represent the concerns of the residents on a consultative committee.






UNFINISHED BUSINESS

Out of City Water Service - 228 West Enderby Road

Mayor Phillips advised that she was not prepared to reintroduce consideration of the request for out of city water service at 228 West Enderby Road until such time as the City receives a decision on its application for funding for expansion of the Water Treatment Plant. However, she has requested a report from staff on the chronology of events for information purposes.

REPORTS

Councillor Ludwig

Councillor Ludwig reported her attendance at a meeting of the Emergency Social Services organization, as well as a meeting of Success by Six.

Councillor Ludwig also advised of her discussion with Member of Parliament Colin Mayes whereby he indicated that 50% funding from the Federal Government was available for highway improvements between Larkin Cross Road and Salmon Arm.

Councillor Shipmaker

Councillor Shipmaker advised that the Regional District was still pursuing expansion of the regional transit system, however, funding apportionment has not yet been determined. He further advised that carpool.ca would be put into effect.

Councillor Case

Councillor Case advised that he had represented Council at the Enderby and District Lions Club 60th anniversary celebrations; and further that the Economic Development Committee of the Chamber of Commerce was considering holding a recreation fair at the curling rink next month.

Councillor Wejr

Councillor Wejr reported as follows regarding business of the Enderby/Area F Services Committee:

- Arena renovations are nearing completion;
- Discussion regarding the Fortune Parks Master Parks Plan;
- Distance and exit signage are in place on the Shuswap River;
- Approval of the use of the arena for the 2008 A.L. Fortune graduation ceremonies;
- Voting regarding the Kingfisher School acquisition to be held on October 15, 2007.

Councillor Wejr also reported that she had attended the groundbreaking ceremonies for a new assisted living facility in Sicamous and was attempting to schedule a meeting with the Minister of Health to discuss Enderby's efforts to secure assisted living beds.

Councillor Cyr

Councillor Cyr reported as follows:

- Funding for palliative care furnishings in Enderby was being held by the Vernon Jubilee Hospital Foundation on behalf of the Enderby community;
- Attendance at the public gathering in Barnes Park last week regarding drugs and associated crime.

NEW BUSINESS

Official Community Plan Amendment Bylaw No. 1402, 2007
Zoning Amendment Bylaw No. 1403, 2007
Lot 3, DL 150, K(formerly O)DYD, Plan 30301 - 407 Kildonan Avenue
Applicant: Alfonso de Vega

The Planner introduced the application and reviewed the recommendations of Development Services.

Concern was expressed with respect to some of the variances that would be required to enable development as outlined in the site plans provided. The Administrator advised that the specifics of the development would be addressed through the development permit and development variance permit application processes, however, she would ensure that the applicant was advised of the concerns.

Moved by Councillor Ludwig, seconded by Councillor Case that Official Community Plan Amendment Bylaw No. 1402, 2007 be given First and Second Reading and referred to Public Hearing;

And further that Zoning Amendment Bylaw No. 1403, 2007 be given First and Second Reading and referred to Public Hearing;

And further that final adoption of Official Community Plan Amendment Bylaw No. 1402, 2007 and Zoning Amendment Bylaw No. 1403, 2007 be considered in conjunction with a lot frontage waiver request, a Development Variance Permit application and a Development Permit application for the form and character of the proposed multi-family development;

And further that final adoption of Official Community Plan Amendment Bylaw No. 1402, 2007 and Zoning Amendment Bylaw No. 1403, 2007 be withheld until all servicing issues have been addressed to the satisfaction of the City of Enderby.

Permissive Tax Exemptions for 2008

The Administrator advised that the properties listed in the memorandum would be included in the permissive tax exemption bylaw for 2008 unless otherwise directed by Council.

Fortune Parks Comprehensive Parks Plan

Moved by Councillor Wejr, seconded by Councillor Shipmaker that Council recommend:

- That the Recommended Best Practices of Parkland Acquisition Best Practices Guide be adopted and that the Official Community Plans for both the City of Enderby and Electoral Area 'F' of the Regional District of North Okanagan be amended accordingly;
- That the Fortune Parks and Recreation District require that the 5% dedication/cash-in-lieu provision be used for the acquisition of passive parks/natural areas and that development cost charges be used towards community and neighbourhood parks and that the Official Community Plans for both the City of Enderby and Electoral Area 'F' of the Regional District of North Okanagan be amended accordingly;
- That Fortune Parks and Recreation adopt the standard of four hectares per 1,000 people and exclude school district lands for active community and neighbourhood parks, schools and regional active parks, excluding passive parks, and that the Official Community Plans for both the City of Enderby and Electoral Area 'F' of the Regional District be amended accordingly;
- That Fortune Parks and Recreation reconfirm the policies adopted in the 1976 Comprehensive Parks Plan and the Official Community Plans for both the City of Enderby and Electoral Area 'F' of the Regional District of North Okanagan, and that any desired changes be incorporated into the Official Community Plans when amended or updated.
