Minutes of a Public Hearing held on Tuesday, September 7, 2004 at 7:00 p.m. in the Council Chambers of City Hall.

Mayor Phillips read the rules of procedure for the evenings public hearings.
Mayor Phillips introduced the following bylaws which all apply to one property:

Zoning Amendment Bylaw No. 1352, 2004
Lot 1, Plan KAP61900, DL 150, K.D.Y.D. (North Enderby Distribution) from Tourist and Commercial Zone (C.2) to Service Commercial Zone (C.4)
Text Amendment Bylaw No. 1353, 2004
To amend Section 503.11.b of the City of Enderby Zoning Bylaw 966 to allow outdoor storage of lumber products in the Service Commercial Zone
The Planner outlined the purpose and effect of each bylaw.
Mayor Phillips invited comment from the public regarding the above noted bylaws.
The Administrator read letters from the following persons, all opposing the proposed zoning change:
Ted Decock of Western Budget Motel, 103 George Street disagrees with the idea of putting lumber storage on a major street.
Jonathan Turpin of 223 Salmon Arm Drive spoke to the text amendment to the zoning bylaw which would permit lumber storage in the Service Commercial Zone. He is concerned that there is no mention of height of the lumber. If lumber were to be stacked and cross tied, it could reach a height of up to 35 feet. Mr. Turpin provided WCB criteria pertinent to lumber stacking height.
Cory Sweet of Fishermans Direct Seafood, 125 George Street feels that lumber storage next to his restaurant would decrease business.
Duncan Walker of 813 Regent Avenue stated that the City should support a business that is creating employment opportunities rather that pushing industry out of town. He feels that the property is otherwise useless.
Keith Wells of Western Budget Motel, 103 George Street is concerned about the noise generated from large lumber trucks. He feels that motel guests, as well as residents who live at the motel would be disturbed.
Duane Baumle of North Enderby Distribution, 207 George Street (the applicant) stated that he is an independent lumber company that has managed to grow his business in difficult times. He simply wants to move his business forward. He does not want to upset residents of Enderby. He has been running a tight ship on Old Vernon Road and has no unsightly waste issues. He has simply outgrown his current property. He explained that there would be no access on or off of the highway. Trucks would access property from Old Vernon Road, thus not creating any traffic issues on the highway. He stated that he understands the aesthetics and gateway concerns and will install fencing and landscaping. Lumber stacks would not be higher than 14 15 feet.
In answer to Councils questions, Mr. Baumle stated that 6-8 jobs would be created once the planer was installed. Drawings showing proposed landscaping and storage were circulated. Operating hours will be from 7:00 a.m. 3:30 p.m.
David Warhurst of Cobwebs Antiques, 200 George Street expressed his concern about heavy equipment operating on the property.
Ginny Dournovo of Enderby Growland, 1900 George Street expressed concern about promises which the City does not enforce. She noted that the car wash had said they would operate at specific times and now operate as they want. They were also supposed to landscape, but the lot is just full of tall weeds. She stated that she is sceptical about promises made when the City does not have a means of enforcement.
Duane Baumley (applicant) stated that there are bylaws covering noise and operating hours. He has a clean track record and has always complied with the rules.
Jonathan Turpin of 223 Salmon Arm Drive asked whether changes to the bylaw wording would effect all properties in the C4 zone. The Planner responded that unless the wording specifically applied to this particular property, it would apply to all properties in the C4 zone.
Ted Decock of Western Budget Motel, 103 George Street stated that the property drops about 30 feet. Huge trucks next to the Motel will generate a lot of dust. He cited an example in Leduc where a motel was negatively impacted when a neighbouring property was re-zoned.
There were no further comments or submissions relating to the above-noted bylaws.
